Without informed consent from the patient, a health care provider cannot provide treatments.

Decision Making Capacity

In some instances the patients aren’t equipped with the capabilities to fully understand their treatment options and the risks/benefits associated with each one. In other situations patients may not be able to effectively communicate their decision to health professionals. Under these circumstances the patient is said not to have adequate capacity to make decisions. If a family member is not present, or court-appointed representative could then be able to take over informed consent.

Patients that are strongly influenced by their emotions – such as anxiety or fear, as an example are deemed not able to make decisions. People who are not conscious cannot make decisions on their alone, and external parties have to give consent for treatment instead.
