Informed consent is a legal condition under which a patient is informed of his or her physical state and the treatment suggested by the physician in charge. Decision Making Capacity

The family member, or court-appointed representative could then be able to take over informed consent.
Patients who are heavily influenced by their emotions – such as anxiety or fear for instance – may be determined as not having the capacity to make decisions. Those who are unconscious clearly cannot make decisions on their own. Therefore, outside parties are required to obtain consent instead.

There are certain elements that are generally included in informed consent forms:
The patient’s medical diagnosis/condition
The treatment suggested by the acting physician
The risks and benefits associated with this method of treatment
Alternative treatments are also available, along with their potential risks and benefits
The risks and benefits associated with not accepting any treatment at all
Not only must these items be documented in a written document, but they must also have a discussion with the patient. So, he can be fully aware of all the details of the scenario and will receive immediate responses to any questions that arise.
