Informed consent , a requirement in law is the requirement under which a patient is informed of the condition of their body and the treatment suggested by the physician who is acting as the patient’s physician. Once this information is received the patient is required to sign a consent form with the doctor to treat prior to any form of treatment is offered. Without informed consent from the patient, a health care provider is not permitted to provide treatments.

Decision Making Capacity

In certain situations patients lack the capabilities to fully understand their options regarding treatment, and the risks/benefits associated with each one. In other situations patients may not be able to communicate their choices to health care professionals. In such situations the patient is said to lack the appropriate capacity for decision-making. An individual from the family or court-appointed representative in this case, can perform informed consent instead.

Patients who are greatly influenced by their emotions, such as anxiety or fear, for example could be classified as not having the capacity for decision-making. People who are not conscious cannot make decisions on independent of themselves, so outsiders have to give consent for treatment instead.

There are certain elements that are common to all consent forms:

The patient’s medical condition/diagnosis

The treatment suggested by the physician in charge

The risks and benefits associated with this method of treatment

Alternative treatments are offered, as are their potential risks and benefits

The dangers and advantages of refusing treatment at all

The items should not only be recorded in the documentation however, they must been discussed by the patient. So, he can be fully aware of all the details of the scenario and will be able to get immediate answers to any questions that arise.
