Informed consent constitutes a lawful condition that requires that a patient be provided with specific information regarding his or her physical state and the recommended treatment by the physician in charge. After receiving this information, the patient must give the doctor their consent to treat prior to any form of care can be offered. Without informed consent from the patient an health care professional cannot provide treatment.

In some cases, patients do not possess the knowledge to fully comprehend their options in terms of treatment and the potential risks and benefits associated with each one. In other instances patients may not be able explain their decisions to health workers. In these situations, the patient is said not to possess the proper capacity to make decisions. Family members or a court-appointed representative will then be permitted to provide informed consent instead.

Patients that are strongly influenced by their emotions – such as anxiety or fear, for example are deemed not able to make decisions. Patients who are in the state of unconscious can’t make decisions on own, and outside parties need to consent to treatment instead.
