In these situations it is believed that the patient to lack the necessary capacity to make decisions. Family members or a court-appointed representative, can take over informed consent.
Patients who are strongly affected by their emotions, such as anxiety or fear, for instance – may be determined as not possessing decision making capacity. People who are not conscious are unable to make decisions on their independent of themselves, so outsiders have to give consent for treatment instead.

The treatment that is recommended by the doctor in charge
The risks and the benefits associated with this treatment
Alternative treatments that are available, as well as their potential risks and benefits
The benefits and risks associated with not accepting any treatment whatsoever
Not only should these details be documented, but they must also been discussed by the patient. This way, he or she will fully understand the details of the situation and will receive immediate responses to any questions that may arise.
