In other instances, patients may not be able communicate their choices to health workers. In such situations it is believed that the patient not to possess the proper capacity for decision-making. A family member or court-appointed representative, will then be permitted to perform informed consent instead.

Patients who are heavily influenced by their emotions, such as anxiety or fear, for example are deemed lacking the ability to make decisions. The ones who are asleep clearly cannot make decisions on independent of themselves, so outsiders must provide consent for treatment instead.
