Patients who are greatly influenced by their emotions, like anxiety or fear for instance are deemed not having the capacity to make decisions. The ones who are asleep clearly cannot take decisions on their independently, and other people must provide consent for treatment instead.

Certain elements are included on all informed consent forms:
The diagnosis or medical condition of the patient.
The treatment that is recommended by the medical professional in charge
The risks and benefits associated with this procedure
Alternative treatments are readily available, along with their benefits and risks
The potential risks and rewards with accepting no treatment whatsoever
Not only must these items be recorded in the patient’s medical records however, they must have a discussion with the patient. This way, he she will fully understand all the details of the scenario and can get direct answers to any questions that be arising.
